FOSTERS C&B PROMOTION 2023: TERMS & CONDITIONS
These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.
The personal data provided by entrants will only be used by the Promoter for the purpose of conducting the promotion and at all times in accordance with the Data Protection Act 2018 and the Promoter’s Privacy Policy (available at www.heineken.co.uk/legal-hub/heineken-brands-privacy-policy). From time to time, the Promoter may share entrants’ personal data with their agents/representatives to assist with administering the promotion and contacting entrants (as necessary) and/or fulfilling the prize(s).
1. Only open to residents in the UK (excluding Channel Islands and Isle of Man) aged 18 or over, excluding employees of any company in the Heineken group and any person whom, in the Promoter’s reasonable opinion, should be excluded due to their involvement or connection with this promotion.
2. No purchase necessary to enter. To take part in the promotion, go to https://www.fosters.co.uk/pubbanter and input your first name, last name and email address along with your cock and bull story. Story is limited to 501 characters on initial entry form with scope to submit longer story via additional form if so desired. No photographs are accepted. Entry is limited to one per person per day. Your standard network rates apply.
3. Entries must be made personally. Entries made through agents/third parties, bulk entries or automated entries are invalid. Multiple entries in excess of the limited set out in Term 2 will be invalid. No entries submitted via any other means will be accepted. The promoter cannot guarantee uninterrupted or secure access to the web entry route. Any mechanical reproduction or automated entries is prohibited, and any use of such automated devices will cause disqualification. The promoter accepts no responsibility for lost, incomplete, or delayed entries, such entries will be void. Proof of entry is not proof of receipt and promoter does not accept any responsibility for the non receipt or the late receipt of message due to network failure or for any associated costs to entrants.
4. Enter from 9:00 10/07/2023 until 11:59 21/08/2023.
5. There 101 individual prizes of £50. Each winner will be contacted, and prize deposited into the winner’s bank account. No entrant may win more than one prize.
6. The winners will be the first 101 entries drawn at random from all qualifying entries by an independent judge on or before 1/09/2023. The Promoter reserves the right to verify all entries and the winners and to refuse to award a prize or withdraw a prize entitlement and/or refuse further participation and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter in any decisions, and these will be binding, and no correspondence will be entered into.
7. The winners will be contacted on or before 11/09/2023. The winners will be notified via email to the email address with which the entry was made. If winners cannot be contacted or do not reply within 7 days to accept their prize, the Promoter reserves the right to re-draw and select new winners at random from all valid entries (and so on until winner can be contacted who will take up the prizes).
8. The winners will have 7 days from receiving the email as set out in Term 7, starting on the day they accept their prize to provide their full name and bank account details.
10. Winners’ details (first names and county only) will be available for 3 months from 18/092023 by sending a Stamped Addressed Envelope to FOSTERS C&B COMPETITON WINNER, Mesh Marketing, 16 Laystall St, London, EC1R 4PF. By entering, the winner consents to such information being disclosed upon request.
11. There is no alternative to these prizes in whole or in part. Prizes are not transferable or refundable. The Promoter reserves the right to reclaim the prize if it is transferred.
12. The decision of the promoter in all matters is final and binding and no correspondence will be entered into.
13 The promoter is not responsible for any third-party acts or omissions.
14. The promoter reserves the right to cancel or amend this promotion due to events or circumstances arising beyond its control.
15. By submitting your story you are agreeing and confirming that:
- You shall be solely responsible for your story.
- The entire copyright in the submission and all content included in it of any nature, including images, script etc is original and belongs to you
- You have permission from all people appearing in the entry to submit the submission for these purposes;
- Your story does not disclose any personal or confidential information belonging to you or anyone else;
- Your submission is not obscene, offensive, discriminatory or libellous;
16. All taxes (including without limitation national & local taxes) in connection with any prize & the reporting consequence thereof, are the sole responsibility of the prize winner.
17. These rules and any dispute or difference arising out of or in connection with them shall be governed by and construed in accordance with English law. The Promoter and each entrant irrevocably agrees to submit to the exclusive jurisdiction of the Courts of England and Wales over any claim or matter arising under or in connection with these rules or the legal relationships established by this agreement.
